1. Who We Are and What This Policy Covers
Blue Pixel Creates, LLC ("Blue Pixel Creates," "BPC," "we," or "us") is an engagement marketing agency organized in Maryland. This Privacy Policy applies to bluepixelcreates.com, any other websites we operate that link to this policy, our social media pages, and emails we send that link to it (together, the "Sites").
It does not apply to websites, apps, or experiences we build or run for our clients unless they link to this policy. Those are governed by the client's privacy policy and the terms posted with that experience (see Section 7).

Information you give us. When you contact us, request a proposal, subscribe to updates, apply for a job, or register for an event or promotion we run, we collect what you provide, typically your name, email address, phone number, company, job title, and the content of your message or application.
Information collected automatically. When you visit the Sites, we and our service providers automatically collect information about your device and your visit, such as your IP address, browser and operating system, the pages you view and how long you stay, how you interact with pages (clicks, scrolling, and mouse movement), the site you came from, an approximate location derived from your IP address, and identifiers stored in cookies and similar technologies (see Section 4).
Visitor identification. When you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email. We (or service providers on our behalf) may then send communications and marketing to these email addresses. You may opt out of receiving this advertising by visiting https://app.retention.com/optout.
In plain terms: we use a visitor identification service, RB2B (operated by Retention.com), that may match your visit to business contact information in its databases, such as your name, job title, employer, business email address, and LinkedIn profile URL. RB2B performs person-level matching only for visitors located in the United States; visitors outside the U.S. are identified at the company level only. We use this information to understand which companies are interested in our services and to follow up with relevant business contacts. You can opt out at any time at https://app.retention.com/optout or by declining marketing cookies in our cookie banner.
Information from other sources. We may receive information about you from business partners, publicly available sources (such as company websites and LinkedIn), social media platforms, and data providers, and combine it with information collected on the Sites.

Embedded video players may also set cookies when you play a video.
Your choices. When you first visit, our cookie banner lets you accept all cookies, decline non-essential cookies, or choose by category. Global Privacy Control. We honor Global Privacy Control (GPC) signals. 5. How We Share Information
We do not sell your personal information for money. We share it in these situations:

Clients and promotion sponsors, when you take part in an event, contest, or campaign we run for a client, as described in the rules or sign-up terms for that activity (see Section 7).
Business transfers, if we are involved in a merger, acquisition, financing, or sale of some or all of our business.
Legal and safety, to comply with the law or legal process, or to protect the rights, safety, and property of BPC, our clients, our users, or others.
With your consent or at your direction.
Some state privacy laws treat the use of visitor-identification and advertising cookies as a "sale" or "sharing" of personal information or as "targeted advertising." You can opt out as described in Section 6.

Sale, sharing, and targeted advertising. Use the same controls, or the "Your Privacy Choices" link in the footer. We also honor GPC signals (Section 4).
Marketing emails. Click "unsubscribe" in any marketing email we send, or email unsubscribe@bpcreates.com with the subject line "unsubscribe."
State privacy rights. Depending on where you live (for example, California, Virginia, Maryland, Colorado, Connecticut, Texas, Oregon, and a number of other states), you may have the right to access, correct, or delete the personal information we hold about you, to receive a portable copy of it, to opt out of targeted advertising, sales, and certain profiling, and to appeal if we decline a request.
To exercise any of these rights, email info@bpcreates.com with the subject line "Privacy Request" and tell us which right you are exercising and the state you live in. We may need to verify your identity before responding, and we will respond within the time required by applicable law. Where the law allows, you may use an authorized agent to make a request on your behalf. We will not discriminate against you for exercising your privacy rights.
7. Client Campaigns, Events, and Promotions
We design and run experiences, events, contests, sweepstakes, and campaigns for our clients. When you take part in one, the client (and any sponsor) may collect your information directly or receive it from us, and the client's privacy policy and the official rules or sign-up terms for that activity apply alongside this policy. Where those terms differ from this policy, they control for that activity.
8. Data Retention and Security
We keep personal information for as long as needed for the purposes described above, for example while we are in contact with you about a project and for a reasonable period afterward, unless a longer period is required by law or a signed agreement. We use reasonable administrative, technical, and physical safeguards to protect it, but no method of transmission or storage is completely secure. Please do not send us sensitive information, such as payment card numbers, by email.
9. Children
The Sites are intended for business audiences and are not directed to children under 18. We do not knowingly collect personal information from children.
10. Visitors Outside the United States
The Sites are operated from the United States, and your information will be processed and stored there. If you visit from outside the U.S., person-level visitor identification is not performed, although company-level identification may occur. You also have the option to opt out of the collection of your personal data in compliance with GDPR by visiting https://www.rb2b.com/rb2b-gdpr-opt-out.

2. Our Content and Intellectual Property
Everything on the Sites, including text, graphics, logos, photographs, video, case studies, and the design of the Sites themselves, is owned by BPC or used with the permission of our clients and partners and is protected by copyright, trademark, and other laws. Client names, logos, and work shown on the Sites belong to their respective owners and appear for portfolio purposes only; nothing on the Sites grants you any rights in them.
You may view the Sites, share links to them, and download or print pages for your personal or internal business reference. You may not copy, modify, republish, distribute, sell, or create derivative works from our content or our clients' work for any other purpose without our written permission.
3. Acceptable Use
You agree not to: use the Sites for any unlawful purpose; scrape, crawl, or harvest content or data from the Sites by automated means beyond ordinary search-engine indexing; interfere with the security or operation of the Sites; attempt to access non-public areas of the Sites; misrepresent who you are or your affiliation; or introduce malicious code.

Our total liability for any claim relating to the Sites will not exceed one hundred U.S. dollars ($100). You agree to defend, indemnify, and hold harmless BPC and its members, managers, employees, and contractors from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Sites or your violation of these Terms.

These Terms and any dispute relating to the Sites are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any legal action relating to the Sites must be brought in the state or federal courts located in Virginia, and you consent to their jurisdiction.
10. Changes to These Terms
We may revise these Terms at any time by posting the updated version here with a new "Last Updated" date. Your continued use of the Sites after changes are posted means you accept the revised Terms.
11. General
These Terms and the Privacy Policy are the entire agreement between you and BPC about your use of the Sites; they do not replace any signed agreement between us. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it.
